Terms of Service

Effective October 16, 2026

The short version. Devsey is operated by Nassau Technologies, LLC. You install our software on your own servers and you are responsible for those servers and everything on them, including backups. We work hard to build safe software and to protect your account information, but we make no guarantees, and Nassau Technologies, LLC is not liable for anything that happens to your servers, your data, or your business. Please read the full terms below.

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and Nassau Technologies, LLC ("Devsey", "we", "us", "our"). They apply to the Devsey website, your Devsey account, the Devsey module catalog, our software repositories, the server linking tool, and all modules and packages we publish or sell (together, the "Service"). By creating an account, linking a server, buying a module, installing our software, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for a company or other organization, you confirm that you have authority to bind it, and "you" includes that organization.

2. Eligibility and your account

You must be at least 18 years old and able to form a binding contract. You must give accurate account information and keep it current. You are responsible for keeping your password and your server link tokens secret and for everything done with them. Tell us promptly at support@devsey.com if you think your account or a token has been compromised. We may rely on any action taken with your credentials as yours.

3. What the Service is

The Service provides software modules, mainly for the Cockpit web console on Linux, together with a website, a catalog, a package repository, and tools that link a server to your account so it can receive modules you are entitled to use. Modules are installed and run on servers that you own or control. We do not host, operate, administer, monitor, or have access to your servers or the data on them.

4. Your servers and your data are your responsibility

This section is the core of these Terms. By using the Service you agree that:

  • You are solely responsible for your servers, systems, networks, files, databases, configurations, credentials, and all data stored on or passing through them ("Your Environment").
  • You must keep your own backups and be able to restore Your Environment. Take a full backup or snapshot before installing, updating, or removing any module.
  • You must test first. Try modules and updates on a non-production system before using them on anything important.
  • Modules can be powerful. A module may run with elevated privileges and can read, change, move, or delete files, settings, services, users, and data on a server. You decide what to install, and you accept the risk of installing it.
  • We are not responsible for any damage to, loss of, corruption of, exposure of, or unauthorized access to Your Environment or any data in it. This includes downtime, failed or interrupted updates, misconfiguration, data loss, security incidents, hardware or hosting failures, compatibility problems, and the actions of anyone with access to Your Environment, whether the cause is our software, our website, our repositories, a mistake, a defect, a third party, or anything else.
  • You are responsible for security of Your Environment, including patching, firewalls, access control, and monitoring, and for complying with the laws and contracts that apply to your data.

We will do our best to build and distribute our software carefully, to sign our packages, and to protect the information you give us. That is an effort, not a promise of any result, and it does not make us responsible for Your Environment.

4A. Backups and recovery

We do not back up Your Environment and cannot restore it. Linked-server information on our side (a server name and a hashed token) is not a backup of anything.

5. Free and paid modules; payments

Some modules are free. Premium modules are sold for a one-time payment that gives access for the period shown at checkout, currently one year from purchase unless stated otherwise. Prices are shown before tax unless noted; applicable taxes are added at checkout. Payments are processed by Stripe, and we do not receive or store your full card number. Stripe's terms apply to the payment itself.

When access ends, you may lose the ability to install or update that premium module from our repository. Software you already installed stays on your server, but we give no promise of continued support or updates for it. Except where the law requires otherwise, all sales are final and refunds are at our discretion. If we refund a purchase, access to that module ends. We may change prices, modules, and offers at any time; changes do not affect a period you have already paid for. You are responsible for any taxes or duties that apply to you.

6. Our software and your license

Subject to these Terms and, for premium modules, to payment, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the modules on servers you own or control, for your own use. Each premium module license is tied to the account that bought it. You may not resell, sublicense, publish, or share premium modules, repository access, or your link tokens, or remove license or signature checks, or use the Service to build a competing product. Nassau Technologies, LLC and its licensors keep all rights not expressly granted. Some components may be offered under separate open source licenses, and those licenses govern those components.

7. Acceptable use

You agree not to: break the law; attack, probe, overload, or disrupt the Service; try to access accounts, servers, or data that are not yours; bypass rate limits or access controls; use the Service to install malware or to harm others; or help anyone else do these things.

8. Third-party services and software

The Service depends on third parties, including Stripe for payments, hosting and email providers, Linux distributions, Cockpit, and other open source software. We do not control them and are not responsible for their availability, security, content, or actions. Your use of them is governed by their own terms.

9. No warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL MODULES, PACKAGES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY MODULE WILL WORK WITH YOUR SYSTEM OR WILL NOT CAUSE DAMAGE OR DATA LOSS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NASSAU TECHNOLOGIES, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS (THE "DEVSEY PARTIES") WILL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, INCLUDING ANY DAMAGE TO, LOSS OF, OR UNAUTHORIZED ACCESS TO YOUR SERVERS, SYSTEMS, OR DATA, ANY DOWNTIME, ANY LOST PROFITS, REVENUE, BUSINESS, OR GOODWILL, AND ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE, AND WHETHER THE CLAIM IS IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY.

IF, DESPITE THE ABOVE, THE DEVSEY PARTIES ARE FOUND LIABLE FOR ANYTHING, THEIR TOTAL COMBINED LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) ZERO DOLLARS IF YOU PAID US NOTHING. THESE LIMITS ARE A BASIC PART OF THE DEAL AND REFLECT THE PRICE AND RISK OF THE SERVICE. SOME PLACES DO NOT ALLOW CERTAIN LIMITS, SO PART OF THIS SECTION MAY NOT APPLY TO YOU, AND IN THAT CASE THE LIMITS APPLY AS FAR AS THE LAW ALLOWS.

11. Release

To the fullest extent permitted by law, you release the Devsey Parties from all claims, demands, and damages, known or unknown, arising out of or connected with Your Environment, your use of the modules, or events outside our reasonable control. If you are in a place where a general release does not cover unknown claims, you waive that rule as far as the law allows.

12. Indemnity

You will defend, indemnify, and hold harmless the Devsey Parties from any claim, loss, liability, or expense (including reasonable legal fees) arising from Your Environment, your data, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

13. Suspension and ending

You can stop using the Service at any time, unlink your servers from your account, and ask us to delete your account. We may suspend or end your access, or remove modules or the Service, at any time, with or without notice, including if we think you broke these Terms or put the Service or others at risk. Sections that by their nature should survive ending will survive, including sections 4, 9, 10, 11, 12, and 15.

14. Changes

We may update these Terms. The effective date at the top shows when they last changed. If you keep using the Service after a change, you accept the updated Terms. If we make a material change we will try to give notice, for example by email or on the site, but it is your job to check back.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that is not resolved informally must be brought in the state or federal courts located in or serving Nassau County, New York, and you consent to those courts' jurisdiction and venue. Before filing a claim, you agree to contact us at support@devsey.com and give us 30 days to try to resolve it. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a part is found unenforceable, the rest stays in effect and that part is enforced as far as the law allows. Our not enforcing a right is not a waiver of it. You may not assign these Terms without our written consent; we may assign them, including in a merger or sale. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree that we may give you notices by email or by posting on the site.
