Acceptable Use Policy (AUP)

1. Introduction

This Acceptable Use Policy (“Policy”) sets forth the rules and restrictions governing the use of the Devsey platform (“Service”), operated by Nassau Technologies, LLC (“Company,” “we,” “our,” or “us”). This Policy is incorporated by reference into the Terms of Service. By accessing or using the Service, you agree to abide by this Policy.

2. Authorized Testing

You may use the Service solely to perform browser testing on websites, applications, or infrastructure that you:

  • Lawfully own or control; or
  • Are expressly and verifiably authorized in writing by the owner to test.

You are solely responsible for ensuring that you possess the necessary legal rights, permissions, and consents before initiating any tests.

3. Prohibited Uses

You shall not use the Service to:

Unauthorized Testing

  • Test any system, application, or property without appropriate ownership or authorization.

Malicious Conduct

  • Upload, transmit, or execute malware, viruses, worms, Trojan horses, ransomware, or other harmful code.

Disruption and Abuse

  • Conduct denial-of-service (DoS), distributed denial-of-service (DDoS), brute-force, fuzzing, load/stress tests, or any activity intended to degrade, overload, or disrupt systems, whether Devsey’s or third-party.

Unauthorized Access

  • Attempt to bypass authentication, authorization, encryption, or other security measures of the Service or any third-party system.

Data Misuse

  • Capture, exfiltrate, or process personal information or sensitive data without proper authorization and consent.

Illegal Activity

  • Engage in any activity in violation of U.S. law, state law, or international law, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030).

4. Data Restrictions

You may not upload, transmit, or otherwise expose the Service to the following categories of information, unless expressly authorized in writing:

  • Payment cardholder data (PCI-DSS)
  • Social Security Numbers or government-issued identifiers
  • Protected health information (PHI) regulated under HIPAA
  • Biometric identifiers
  • Confidential data of third parties without consent

You are solely responsible for redacting or anonymizing test inputs and artifacts to avoid unauthorized processing of such data.

5. System Abuse

In addition to the restrictions above, you may not:

  • Attempt to probe, scan, or test the vulnerability of the Service or any network without authorization;
  • Circumvent or tamper with Service monitoring, logging, or rate-limiting controls;
  • Interfere with or disrupt other users’ use of the Service;
  • Resell, sublicense, or provide unauthorized access to the Service to third parties.

6. Enforcement

Violations of this Policy may result in:

  • Immediate suspension or termination of your account;
  • Removal of prohibited content or artifacts;
  • Reporting of unlawful conduct to law enforcement;
  • Civil or criminal liability under applicable law.

The Company reserves the right, at its sole discretion, to determine whether any activity violates this Policy.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising from or related to your violation of this Policy.

8. Force Majeure

The Company shall not be liable for any failure to enforce this Policy arising from events beyond its reasonable control, including but not limited to natural disasters, acts of God, governmental actions, network outages, or malicious third-party activity.

9. Entire Agreement

This Policy, together with the Terms of Service and Privacy Policy, constitutes the entire agreement regarding acceptable use of the Service. It supersedes all prior or contemporaneous agreements, communications, or understandings relating to acceptable use.
